Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pixelsurf AI ("Pixelsurf," "we," "us," or "our"), including our website, applications, AI companions, messaging channels, and related services (collectively, the "Service").

By creating an account, signing in, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Pixelsurf AI provides AI-powered companion experiences with persistent memory across supported channels, including browser chat and third-party messaging platforms where available. Companions are generated by artificial intelligence and are not human beings.

We may update, modify, or discontinue features at any time. The Service is provided on an evolving basis and may not always be available or error-free.

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with permission from a parent or legal guardian who agrees to these Terms on your behalf.

You are responsible for maintaining the security of your account and for all activity that occurs under it. Sign-in is currently provided through Google OAuth. You agree to provide accurate information and to notify us if you suspect unauthorized access.

You agree not to:

• Use the Service for unlawful, harmful, or abusive purposes
• Attempt to extract, reverse engineer, or misuse our models, systems, or infrastructure
• Share content that violates the rights of others or applicable law
• Use companions to generate spam, harassment, fraud, or deceptive content
• Interfere with the security or operation of the Service

We may suspend or terminate access if we reasonably believe you have violated these Terms or pose a risk to the Service or other users.

Responses from Pixelsurf AI companions are generated by AI and may be inaccurate, incomplete, or inappropriate. You should not rely on companion output as professional, medical, legal, financial, or emergency advice.

You are responsible for how you use AI-generated content and for decisions you make based on it.

You may provide messages, preferences, persona settings, and other content through the Service ("Your Content"). You retain ownership of Your Content, subject to the license below.

You grant us a limited license to host, process, store, and use Your Content solely to operate, improve, and secure the Service, including persistent memory features you enable. You can review and delete stored memories through the Service where those controls are available.

The Service may integrate with third-party providers such as Google for authentication and messaging platforms for communication. Your use of those services is also subject to their own terms and policies. We are not responsible for third-party services we do not control.

Our collection and use of personal information is described in our Privacy Policy. Billing and refund practices are described in our Refund Policy. By using the Service, you acknowledge those policies.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that companions will meet your expectations, that conversations will be uninterrupted, or that stored memories will always be preserved.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Pixelsurf AI AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim relating to the Service will not exceed the greater of USD $100 or the amount you paid us for the Service in the twelve months before the claim arose.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitations of liability.

We may revise these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Continued use after changes become effective constitutes acceptance of the revised Terms.
